You will not get the game back, your case wouldn't even be heard. It would be thrown out court, you have no claim based on the Terms of Service you agreed on. What other avenues give you just cause to sue for damages?
IF the game was completely down for every day in a month, then you could sue for that month. You can't sue for the game being down 29 days and up 1 day in a month. Their TOS says they can do that and by playing it you agreed. Case closed. Judge wouldn't even hear your case based on that. Frivolous grounds. Anyone can file to sue in court doesn't mean the judge or court will proceeded with your lunacy. If they do it will cost you..... Big time.
Even if you convinced some judge to hear it, and somehow you won. You win would be $7 x months it was completely down plus your court costs. They would appeal and delay your judgement for years. Your judgement is going to be no where near the 20k you think. Even if you get 100's to join you and somehow is pigs started flying and you won.
However the TOS is pretty clear, as down from time to time. Who are you to define how long that time is? It doesn't say it, so technically down time to time could be down for a few months and then be up for a few. Even that doesn't breach there TOS. As long as the game comes back on from time to time they are living up to their TOS. All you can do is not give them your business.
I wonder about the competency of your lawyer if he would be even willing to take this case. He must be starving for work. He'll want a 5k retainer just to talk to you if he was a capable lawyer. You'll spend 20k on a lawyer, loose the case and have to pay 40k for their lawyer. Accomplishing nothing.
